Schumann was shot by a deputy after refusing multiple commands and instructions from those deputies. Schumann remained combative even after having been disabled by the deputy’s shots. According to the criminal complaint filed in Amador County Superior Court Schumann is being charged with six felony counts of assault on a Peace Officer, or Firefighter, with a semi automatic firearm, as well as a special allegation of the attempt to use a deadly weapon. This special allegation will make Schumann, if convicted, ineligible for parole.

Schumann is also being charged as being in possession of two firearms, a .22 caliber revolver and a .45 caliber semi-automatic pistol. Schumann is not allowed to own or possess these weapons because he is a repeat offender that was convicted in the last 10 years of Penal Code 422. This Penal Code includes willfully threatening to commit a crime which will result in death or great bodily injury to another person, with the specific intent to threaten an individual.
