Jackson Planning Commission To Send Admonishment To Developer That Did Not Follow Ruling

The Jackson Planning Commission met last night and one of the items before them was the review of the Conditional Use Permit for K. Hovnanian Forecast Homes Temporary Model Home Sales Office.  On November 20, 2006 the Planning Commission reviewed the businesses request for a conditional use permit to operate their temporary model home sales office in Pine Meadows subdivision on Scottsville Boulevard. At that time the office included signs and flags, which many nearby residents said were not appropriate for a residential neighborhood.
Since the City’s code allowed for temporary signs the questioned echoed throughout that November night was “what is the city of Jackson’s definition of the word temporary”? After a long discussion and hearing from the public the Commission decided in the Fall that only one monument sign per home would be allowable and that the flags and all other signs must come down. The Commissioners only approved the Conditional Use Permit with the following conditions: that K. Hovnanian Homes must remove the flags immediately, that there is to be only one monument sign per home, and that the use permit be reviewed within 6 months. Last night was the overdue 6 month review of the Conditional Use Permit. According to the staff report, “Due to a noticing error, the review was postponed to tonight’s meeting.” Last night there was no public comment however the Planning Commissioners had plenty to say. Commissioner Teri Works commented that she had driven by the development soon after the decision to allow monument signs and the developer had not complied with the request. She went by again recently and still the developer had not replaced its banner and regular for sale signs with the required monument sign. Commissioner Leticia Sexton stated that she too had been monitoring the situation and also felt that the developer had not complied with the city’s rules. The Commission ultimately decided to send a letter to the developer and remind them their 6 months is up, as well as what the approved conditions for signage is…Commissioners Sexton and Works will continue to monitor the situation.
